An employee takes a day of FMLA leave, which is properly certified by her doctor. However, the employee is later spotted at a birthday party that day at 4:30 p.m. in the afternoon, which overlaps by 30 minutes with the shift she would have been working if she had not called in sick (her shift ended at 5:00 p.m.).
